These Terms of Service ("Terms") govern your use of the Hair AI Salon mobile application and this website (together, "the Service"), operated by Mathew Khairo ("we", "us"). By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service

Hair AI Salon uses artificial intelligence to generate photorealistic previews of hairstyles, haircuts and hair colours on photographs you provide. The Service is provided for personal, non-commercial use to help you visualise a potential change before making it.

Eligibility

You must be at least 13 years old to use the Service. By creating an account you confirm that you meet this requirement and that any information you provide is accurate.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us promptly if you believe your account has been used without your authorisation. You may delete your account and associated data at any time from within the app, as described in our Privacy Policy.

Credits, Purchases and Subscriptions

Certain features consume credits. Credits may be provided free of charge or purchased through the Apple App Store or Google Play Store.
All purchases are processed by Apple or Google, not by us, and are subject to their respective terms and refund policies.
Credits have no cash value, are non-transferable, and cannot be exchanged for money.
Subscriptions renew automatically unless cancelled through your App Store or Google Play account settings before the end of the current billing period.
Refund requests must be directed to Apple or Google, as we are unable to process them on your behalf.

Your Content

You retain ownership of the photographs and other content you upload ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive licence to process, store and transmit it solely for the purpose of operating the Service and delivering the results you request — including transmitting it to the third-party AI providers described in our Privacy Policy.

This licence exists only to run the Service. We do not use Your Content for advertising, and we do not use it to train AI models.

You confirm that you have the right to upload Your Content, and that doing so does not infringe the rights of any other person. Please do not upload photographs of other people without their permission.

Acceptable Use

You agree not to use the Service to:

Upload unlawful, harmful, harassing, hateful or sexually explicit material
Upload images of other people without their consent, or images of minors other than your own children
Create content intended to impersonate, defame, deceive or harass any person
Attempt to reverse engineer, decompile, scrape, or gain unauthorised access to the Service or its underlying systems
Resell, redistribute or commercially exploit the Service or its outputs without our written permission
Interfere with the operation of the Service or circumvent any usage limits or credit system

We may suspend or terminate accounts that breach these rules.

AI-Generated Results

Please note: results produced by the Service are AI-generated visualisations, not photographs and not professional advice. They are approximations intended to help you imagine a change. Actual salon results will vary depending on your hair type, texture, condition, length, your stylist's technique, and other factors outside our control.

You should always consult a qualified hairdresser, barber or colourist before making a significant change. We are not responsible for decisions made, or outcomes obtained, on the basis of a preview generated by the Service.

Intellectual Property

The Service, including its software, design, text, style catalogue and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our name, logo or branding without our prior written permission.

Subject to your compliance with these Terms, you may use the images the Service generates from Your Content for your own personal, non-commercial purposes.

Third-Party Services

The Service relies on third parties including Google Firebase, third-party AI processing providers, and the Apple App Store and Google Play Store. Your use of those services may also be governed by their own terms. We are not responsible for the availability, content or practices of third-party services.

Availability and Changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend or discontinue features at any time, and we may update the credit system, pricing or free allowances. Where changes are material, we will make reasonable efforts to notify you.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you would create a risk to us or other users. Provisions relating to intellectual property, disclaimers and limitation of liability survive termination.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, data, goodwill or opportunity, arising from or relating to your use of the Service. Where our liability cannot be excluded, it is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) resupply of the relevant service.

Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service or for legal, operational or regulatory reasons. Any changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Australia, without affecting any rights you may have to bring proceedings in your country of residence where local law requires it.
